We are a family who had been a customer of Sympatico, the internet arm of Bell Canada’s vast telecommunication empire in Canada, for a number of years now. However after we discovered that Sympatico was now charging us over $30 a month in extra service charges - for using more than 60 GB of bandwidths starting in the fall of last year - when we started to use more than that amount of bandwidths: we contacted Sympatico on November 17th of 2008 and informed them that we would no longer be using their company as our internet service provider. A month later on December 17th of 2008 Sympatico finally disconnected themselves as our internet service provider.

During the 30 day period that we were waiting for Sympatico to remove themselves, as our internet service provider, my family searched the internet looking for another internet service provider that would meet our high standard of working with a company that provides excellent service to its customers, that employed a staff that was respected and receptive to its customers concerns, and did so at a reasonable price – that did not place a limit of 60 GB on bandwidth usage by their customers, as Sympatico Internet Service has been doing to its customers, like us, for over a year now. After doing a lot of research on the internet, we finally decided that there was one internet service provider that met the demanding criteria we set: that company turned out to be Teksavvy.

We have been using Teksavvy as our internet service provider since December 17th of last year, and we intend to continue to use their services in the future. Teksavvy has shown itself to be an internet service provider that actually provides internet users with bandwidth services that is more than three times the 60 GB bandwidth limit which Sympatico places on the use of that service by its customers. Teksavvy is the only company that we found in our search to find a new service provider that still provides its customers with “unlimited bandwidth usage”; and it does so for a current price of just under $40 Cnd. per month.

It is also the only company we discovered that provides its customers with a bandwidth limit of 200 GB at a price of just under $30 Cnd. In fact, though we left Sympatico, because of the 60 GB bandwidth restriction that they place on their customers, and we were looking for a company that provided unlimited bandwidth usage to their customers: we still have not chosen the unlimited bandwidth service that Teksavvy makes available to all of its customers for a decent price of just under $40 Cdn each month. When we left Sympatico it was charging us more than what Teksavvy now charges its customers who are using the unlimited bandwidth service it provide to those customers. We do not use anywhere close to the 100 bandwidth limit that Teksavvy provided us at the time, as one of its customers, which is the reason why we have not yet decided to paying an extra $10 a month for the use of their unlimited bandwidth service.

My family was disappointed, and shocked, when we discovered that Sympatico had charged us an extra $30 for using more than 60 GB of bandwidth in the fall of last year. What disturbed us even more, however, is the unethical and underhanded manner in which a few of Sympatico’s service representatives dealt with us when we contacted them to inform them that we would no longer be using their services. After my husband informed a few of their staff members that we were canceling our internet service with this company, and they confirmed his decision with him, he was transferred to someone in their business office who was suppose to make it official, and cancel the service.

We use a phone system which allows us to use the speaker phone function so that we can listen to certain conversations that any member of our family is having with a caller on the other end, from a place of business especially, without that caller being aware of other members of our family listening to their conversation. And the rest of our small family members, my daughter, and myself, listened very closely to the conversations that my husband was having that day with different Sympatico staff members. To our surprise, and dismay, this employee working inside Sympatico’s business office decided to try to coax my husband into changing his mind about canceling our internet service with this company by making a last ditch effort to try to entice him into continuing to use their service. These were his exact words, or close to it:

“Mr Kavanaugh, how about if we increase your current bandwidth limit from 60 GB, which it now is, to 100 GB, for the same price that you are paying now.”

We were all taken back by the unethical and deceitful practice that this employee working for Sympatico was engaging in, in an effort to entice my husband into changing his mind about canceling our internet service with them. What this Sympatico employee was doing was not only immoral and unethical – but he was engaging in a practice that should not even be legal in this country. It is a self serving practice which reveals that Sympatico was following a policy where their employees were willing to offer only customers who had decided to stop using them as their internet service provider bandwidth use of up to 100 GB, before they were penalized any extra costs for going beyond that limit.

This is a shameful practice because Sympatico has the authority to give its customers a bandwidth limit of up to 100 GB, without imposing any extra cost for them doing so, at the same time that it was offering its customers a maximum of up to 60 GB of bandwidth usage before charging them an amount of up to $30 per month for exceeding that limit at the end of any given month. Sympatico has shown us here that it is a company that does not have any integrity, and a company which is prepared to prostitute itself in its efforts to gouge its customers by using every unethical means that it can to serve its greedy bottom line. When we finally discontinued using their service, this same company continued its unethical business practice, especially against formers customers, by placing a charge of $100 on our bill a month later, which it claimed was “the disconnection fee” that we had apparently agreed to pay years ago when we first agreed to use them as our service provider. It was only after I contacted their office, and spoke to one of their managers, that Sympatico finally agreed to waive that $100 disconnected fee, which we did not agree to pay in the first place, and which they had no legal or moral right to charge us, or any other former customers, after they no longer used them as their service provider.

We are a family who has been trying to build a business of own in order to provide for ourselves because we have long discovered that the different systems that operate in Society today have been undermining our efforts to develop our business of our own. The different industries have a habit of constantly increasing the cost of doing any business, and because of that our business venture continually fails to get off the ground. This has caused our family to end up on government assistance and end up being abused by different workers in these government agencies and in the society in general. The only opening that are provided to families, such as our: is if we agree to go along with the disrespectful and degrading behavior that people in the workplace, as well as in the larger society, are enticed and coerced into taking part in – in order to get along so that they can try to get ahead in this profit driven, asset addicted, youth obsessed, and promiscuously preoccupied society that we live inside of. Because we are a family whose members refuse to participate in the flirting games, the mating rituals, and the seductive games that people living all across this country, and this planet, are being enticed and pressured into playing – at the workplace, inside their homes, in public places, and elsewhere: we have been pushed out of the workplace and forced to live as social outcast, and as a reclusive family for over ten years now.

Every court of law that is there to serve as the instrument of justice has the responsibility of its office, and the trust of the people, to make decisions that protect and defend the truth of any issue that it is asked to pass a judgment on. The case that Sympatico is bringing into the court of law, on behalf of its owner, Bell Canada, is one that is based on a company that is seeking to force a court of law to make a decision that gives Sympatico the right to keep other service providers, like Teksavvy, from providing a service to their customers that allows them to have unlimited bandwidth usage at a price that does not gouge their pocket books. That is the reason why the CRTC gave its blessing to companies like Teksavvy, who are there to serve the best interest of the Canadian customers online, while serving its own best interest and making a fair profit in the process.

Bell Canada has existed as one of the biggest monopolies in the telecommunications industry in this country for a long time now; and it is a profit gouging machine that continues to flex its mighty corporate muscles in an attempt to destroy every company that tries to compete with it for the Canadian consumers who are now part of one of the fastest growing markets, of the future, in this country. Your honor, this Avatar is asking that you study the evidence carefully, so that you can make a truly wise and just decision in this case being brought by the Goliath Ma Bell, to try to destroy the competition, so that it can have free rein to hold the millions of internet users hostage, and charge them as much as they choose while continuing to provide them with more and more restrictive and diminished service for as long as they are allowed to do so.

I have include a copy of the text of the work that I am here to undertake through Project Bring All Beings Together that I am inviting our internet service provider, Teksavvy, to submit on my behalf as one of its satisfied customers who is asking to have her voice be heard by the court of law that is deciding the case that Ma Bell is now making there to try to destroy companies like Tecksavvy so that it can gain a monopoly in this new market in order to limit the freedom, and restrict the rights, of the Canadian consumers to be provided with the choices that they need to have as internet users.
